ITSSD Comments on ‘Desk Review of the Intergovernmental Working Group on Public Health, Innovation and Intellectual Property from a Right to Development Perspective’

 

   

Summary: This ITSSD Letter was drafted in response to A/HRC/12/WG.2/TF/CRP.5 (27 March 2009), issued by the High-Level Task Force on the Implementation of the Right to Development, commissioned by the Intergovernmental Open-ended Working Group on the Right to Development, of the Office of the United Nations High Commissioner for Human Rights. The letter emphasizes that intellectual property rights are property rights, first and foremost, within the meaning of the WTO TRIPS Agreement, and that property rights are human rights as defined by internationally recognized human rights conventions and declarations.

    Summary: This ITSSD Letter and accompanying Annex to Senate Committee on Foreign Relations Objects to the Nomination of US Trans-nationalist Harold Koh as US State Department Legal Adviser. It provides evidence of three of Harold Koh’s views on international law that would arguably threaten US legal, political and economic sovereignty, US individual rights and US national security.
